Terms of service
Draft (2026-10-draft). This document has not yet been reviewed by a solicitor and must be approved before the service is offered to paying customers.
1. Who we are
ATRA Daily Check ("the service") is provided by ATRA Transport Ltd (company number 16193895), 23 Pickups Field Close, Horwich, Bolton, BL6 7FT ("we", "us"). The customer is the business that signs up ("you"). The service is for businesses only, not consumers.
2. The service
The service lets your drivers record vehicle and trailer walkaround checks, defects and incidents on a phone, and lets your managers review them. It is a record-keeping tool. You remain responsible for your operator's licence, for your vehicles being roadworthy, for training your drivers, and for acting on what is reported. The handbook in the service is general guidance and is not legal advice.
3. Accounts
The person who signs up confirms they may accept these terms for the business. You are responsible for who you give access to, for keeping passwords private, and for everything done under your accounts. Tell us straight away if you believe an account has been misused.
4. Free trial
A new business gets a 30-day free trial without giving a card. One trial per business. When the trial ends without a subscription, records stay readable but new checks and changes are paused.
5. Prices and payment
Prices are shown on the pricing page and exclude VAT, which is added at the current rate. You pay monthly in advance by card through our payment provider, Stripe. Charges follow the number of vehicles and trailers set to In use or Off road (VOR); changes during the month are charged or credited for the days left. A minimum monthly charge applies. We may change prices with at least 30 days' notice by email; the new price applies from your next billing period after the notice ends.
If a payment fails, Stripe retries it. If it still fails we may pause new checks until it is paid.
6. Cancelling
You can cancel the subscription at any time in the billing page, effective at the end of the paid period, or close the account at once under Account. No refund is due for a part-month already paid unless the law requires one.
7. Your data
The records you and your drivers enter belong to you. We process personal data in them only on your instructions, as set out in the data processing agreement, which forms part of these terms. You can export your records at any time under Account → Export.
DVSA guidance says to keep walkaround check and defect records for at least 15 months. Export your records before closing the account: after closing, they are deleted after 90 days. If a trial ends and no subscription is taken, the records are deleted 180 days after the trial ended.
8. Acceptable use
Do not use the service for anything unlawful, to upload material you have no right to, to try to reach other customers' data, to test its security without our written permission, or in a way that overloads it. We may suspend an account that breaks this, and will tell you why.
9. Availability
We aim to keep the service available and to fix faults promptly, but do not guarantee it will be uninterrupted. The app can record checks without signal and send them later. Have a fall-back (for example a paper defect sheet) for when a phone or the service cannot be used.
10. Liability
Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud. Otherwise, we are not liable for loss of profit, business or goodwill, or for indirect loss, and our total liability in any 12 months is limited to the fees you paid in that period. [To be reviewed by a solicitor.]
11. Changes
We may update these terms. We will email account administrators at least 30 days before a change that reduces your rights takes effect.
12. Law
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. [To be confirmed.]
